Trouble Continues For Credit Card Collection Actions

Recent decisions in New Jersey and Maine demonstrate the growing burden courts are placing on creditors and debt buyers in credit card debt collection actions. In LVNV Funding, LLC v. Colvell, the New Jersey Superior Court ruled that, to win on a summary judgment motion, a party suing on a credit card account must provide the same proof that is required for a default judgment.

FTC Issues Final Policy Statement About Collecting Deceased Debt

The Federal Trade Commission has released a policy statement clarifying that the agency will not take enforcement action under the Fair Debt Collection Practices Act (FDCPA) or the FTC Act against companies that are attempting to collect the debts of deceased consumers, if the companies communicate with someone who is authorized to pay debts from the estate of the deceased.
