Having debt is a normal situation among many people and particularly individuals who are in the business industry. It is usually because of the idea that for someone to achieve success in his business endeavour, he must take some risks, even if it involves getting buried in debt by borrowing large amount of money from financial institutions and different lending firms. Even though this notion is verified to be true and many were successful as well as currently reaping the rewards of all their hard works, at times this very idea has put others into the pit of unsuccessful business investment and worst, under a huge financial debt that he should settle.

Recent decisions in New Jersey and Maine demonstrate the growing burden courts are placing on creditors and debt buyers in credit card debt collection actions. In LVNV Funding, LLC v. Colvell, the New Jersey Superior Court ruled that, to win on a summary judgment motion, a party suing on a credit card account must provide the same proof that is required for a default judgment.

If you are having trouble maintaining good credit, you might find yourself
being irritated by phone calls from the collection agencies. If your debt
has been handed over to one of these agencies, you already have a black
mark put on your credit report. However it is important to know your
rights when it comes to being in debt. Phone calls from the collection
agencies are unethical and if you understand the laws regarding good
credit, you can protect yourself from the problems and all the illegal
doings of these companies.
The most crucial law to know and review if you think that you are being
treated badly is the Fair Debt Collections Practices Act, or FDCPA. This
is a law that will give you all the information that you may need so that
you understand if that company is doing something wrong. If they are not,
